ITC Investigations of Intellectual Property Infringements: In two connected investigations at the International Trade Commission (ITC) (337-TA-1335 and 337-TA-1336), Professor Daniel Spulber of Northwestern University was hired by Daedalus Prime LLC, the complainant. His role involved examining the scope of the domestic semiconductor industry, assessing the significance and sustainability of related investments, and addressing public interest factors within these investigations.
Impact of Pandora's Reproduction Practices on Market for Music Recordings: In Flo & Eddie, Inc. v. Pandora Media LLC (2:14-cv-07648), Professor Daniel Spulber, the Elinor Hobbs Distinguished Professor of International Business at Northwestern’s Kellogg School of Management, analyzed how Pandora’s reproduction practices impacted the market for pre-1972 recordings.
Analysis of Copyright Royalties: In Bernstein et al v. Cengage Learning, Inc. (1:19-cv-07541), Vega and Dr. Daniel Spulber of Northwestern University are engaged by a putative class of authors who allege its publisher diluted net sales and underpaid contracted royalties.
Valuation of Trademark Infringement: Vega is currently retained to support Dr. Michael Einhorn in a trademark infringement case. Dr. Einhorn will opine on the proper valuation of the alleged improper use of images of plaintiffs.
Patent Valuation: Vega valued a patent for virtual 3D tour technology used by online real estate brokerages. To do so, the Vega team analyzed how the technology contributed to website traffic and conversion rates for a specific online brokerage and it calculated profits with and without the patented technology. Vega also supplied a Georgia-Pacific factor analysis to estimate reasonable royalties in this case.
