Analysis of Competition in the E-Prescribing Market: Dr. Daniel Spulber was retained to analyze and opine on competition in the e-prescribing markets. Dr. Spulber examined how exclusionary contracts limited the choices of users on different sides of the network to utilize multiple service providers and the resulting adverse impact on market competition. Dr. Spulber also proposed a methodology to determine whether and to what extent class members were damaged due to the alleged anticompetitive conduct.
Analysis of Price Fixing and Market Allocation for Certain Generic Drugs: Vega was retained by a group of pension funds as opt-out plaintiffs in a securities case to analyze issues related to a pharmaceutical company's alleged price fixing and market allocation scheme for certain generic drugs.
Analysis of Pricing Pressure and Price Fixing in Generic Drug Market: Vega is retained by a group of major hedge funds as opt-out plaintiffs in several securities class actions to support Professor Lou Rossiter in analyzing issues related to pricing pressures and price fixing for certain drugs in the generic drug market.
Production in Antitrust Case: Vega was designated as the lead consulting firm for receiving and verifying data produced by a large group of insurance companies. Our team assisted counsel by bridging the gap between the data produced in discovery and the expert analysis, ensuring the data was sufficient for the expert analysis anticipated in subsequent phases of the litigation.
BCBS Antitrust Case: A Vega expert was retained to provide an educational presentation to the Alabama Court regarding the key economic issues in the In Re Blue Cross Blue Shield Antitrust Litigation (N.D. Ala. MDL No. 2406). This class action was brought by providers and subscribers to enjoin an alleged ongoing conspiracy to allocate health insurance markets. The expert’s presentation included data visualizations that addressed key issues of the case, including an overview of the Alabama health insurance market, defendants’ market share, and financial statistics.
Investigation of Potential Bond Price Manipulation: Vega was engaged to investigate potential price manipulation in certain bond markets. As part of the engagement, we performed economic analysis using the primary and secondary market transactions that were required to be reported by registered broker-dealers.
Benchmark Rate Antitrust Litigation: Our team provided consulting support in a benchmark rate antitrust class action. Investors in this matter claimed that the allegedly rigged benchmark rates diminished their returns on trades, pension plans, and savings accounts. Vega was retained to assist with development of case strategy and overall case management including providing market and technical analytics. The Vega team also provided comprehensive discovery support.
